Terms of Use (EULA)
Agreement
These Terms of Use (“Terms”) govern your access to and use of the NeuroSound mobile application, website, and related services (collectively, the “Services”) provided by NeuroSound (“we,” “us,” or “our”). By downloading, installing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Eligibility
You must be able to form a binding contract in your jurisdiction to use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.
License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial use in accordance with the applicable app store rules (e.g. Apple App Store). You may not copy, modify, distribute, sell, or lease any part of the Services except as allowed by law.
Health and medical disclaimer
The Services are intended for general wellness and listening experiences. They are not medical devices and do not provide medical advice, diagnosis, or treatment. Always seek the advice of qualified health providers regarding any medical condition. Never disregard professional medical advice because of something you read or experience in the Services.
Subscriptions and payments
Some features require a paid subscription or in-app purchase. Prices and terms are presented at the time of purchase through the applicable app store (e.g. Apple). Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your account settings on your device (for example: Settings > Apple ID > Subscriptions on iOS). We do not control app store billing; those transactions are governed by your agreement with Apple or the relevant store provider.
Acceptable use
You agree not to misuse the Services, including by attempting to access non-public areas, interfere with other users, reverse engineer except as permitted by law, or use the Services in violation of law or third-party rights.
Intellectual property
The Services, including software, design, trademarks, and content (except user content you provide), are owned by NeuroSound or its licensors. No rights are granted except as expressly stated in these Terms.
Termination
We may suspend or terminate access to the Services if you violate these Terms or if we discontinue the Services. You may stop using the Services at any time. Provisions that by their nature should survive will survive termination.
Disclaimer of warranties
The Services are provided “as is” and “as available,” without warranties of any kind, express or implied, to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the maximum extent permitted by law, NeuroSound and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us in the twelve (12) months before the claim or one hundred U.S. dollars (USD $100), except where such limitations are prohibited by law.
Governing law
These Terms are governed by the laws applicable in the United Arab Emirates, without regard to conflict-of-law principles, unless mandatory consumer protection laws in your country require otherwise.
Changes
We may update these Terms from time to time. We will post the updated version on this page and revise the “Last updated” date. Continued use of the Services after changes constitutes acceptance of the updated Terms where permitted by law.
